      No Longer Funny

      by Andrew McCaskey
The student in Orange County is going to find out that hacking stunts from 25 years ago have begun to wear thin.
At first, the potential for 38 years in jail for changing grades from F to A seems excessive. Reading the story more closely, it seems that the activites of which he is accused include breaking and entering with a stolen masterkey – which enabled him to place keyloggers and similar malware on school computers systems and insure his remote access. Add to that the fact that he apparently had a good side business in exam master questions and grade change for hire, and you can see why the local prosecutor is going after him with great enthusiasm.

The second layer – the fact that it was an elite high school and that his home was in an exclusive gated community made for much better copy on the local news.

Here’s the question: How much of this sentence is punishment for his mis-deeds and how much is to set an example for other would-be hackers.

He is listed as age 18. How much of this was done before age 17, as a juvenile ? What’s the responsibility of the school system to safeguard their systems and detect physical compromise and malware ?

Gated community residents generally are able to afford good lawyers. And the odds are, this kid will not get a day past time served.
